The ÉCLAT BAGS mobile messaging service (the “Service”) is operated by ÉCLAT BAGS (“ÉCLAT BAGS”, “we”, or “us”). Your use of the Service constitutes your acceptance of these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any features of the Service at any time, without notice. To the extent permitted by law, we may also modify these Mobile Terms at any time; your continued use of the Service after the changes become effective will be deemed acceptance of those changes.

By opting in to ÉCLAT BAGS SMS/Text messaging, you agree to receive recurring SMS/Text messages from ÉCLAT BAGS to the mobile phone number you provide, even if your number is on any state or national do-not-call lists. Messages may be sent via automatic telephone dialing systems or other technologies. Informational messages may include updates, alerts, and notifications (e.g., order or account updates). Promotional messages may include offers, promotions, and other marketing content (e.g., cart reminders).

You understand that enrollment in this program is not mandatory to make a purchase and that consent is not a condition of purchasing from ÉCLAT BAGS. Participation in the program is entirely voluntary.

We do not charge for the Service, but you are responsible for all fees and charges imposed by your carrier for sending and receiving text messages. Message frequency may vary. Message and data rates may apply. Check your data plan or contact your carrier for details.

You can unsubscribe from the Service at any time by sending the “STOP” command to ÉCLAT BAGS or by clicking on the unsubscribe link (if available) in one of the messages received. You will receive a one-time confirmation message that you have unsubscribed. You will not receive further messages unless you request them yourself. If you have subscribed to other ÉCLAT BAGS SMS services, you will have to unsubscribe from each of them separately, unless otherwise provided by law.

We reserve the right to change the number or short code used to send messages at any time and will notify you of any changes. You acknowledge that any messages (including STOP or HELP commands) sent to a number or code no longer in use may not be received , and we will not be liable for any failure to handle your request .

The telephone operators supported by the Service are not responsible for any delays or failure to deliver messages . It is your responsibility to provide a valid telephone number. If you change your number, you will need to re-enroll in the program with the new number.

To the extent permitted by law, you agree that we will not be responsible for the failure to deliver, delay in, or misreceipt of any message, for any errors in content sent, or for any actions you may (or may not) take in reliance on information received through the Service.
